A number of contractors are now required to have their own professional indemnity policy. Even if the claim was due to an act, error or omission committed by a third party ie Architect, your policy could still be the first one to respond.
If you provide a full design and build service, you could be the clients first port of call in the event of a claim. If the design work is the responsibility of another party ie the Architect, there could also be costs associated when re-directing liability back to the primary policy holder. If you subcontract all your design work to others, you may wish to consider a contingent design liability policy. This will cover the design and build contractor for any legal responsibility which could arise from the professional services performed by the sub- contractor ie the Architect who is responsible for the design work.
